2004 DUI Case Results

Arresting Police Department: Portsmouth

Date:  8-22-04

Defense Counsel:  Attorney Michael J. Robinson

Allegations:

On 8-22-07, at approximately 10:59 P.M., Portsmouth Police were dispatched to a motor vehicle accident scene.  The Defendant driver told the officer he fell asleep and collided into 2 other vehicles.  The arresting police officer claimed to have detected the strong aroma of alcohol coming from the driver’s breath.  Additionally, the Portsmouth Police Officer claimed that the driver had bloodshot eyes.  The driver admitted to having consumed 4 beers and combination with 2 sleeping pills.

The arresting officer administered 3 field sobriety tests, which he claims the driver failed.  He then placed the driver under arrest and charged him with driving under the influence of alcohol.

Disposition:

On September 9, 2004, after multiple pretrial conference appearances by Attorney Robinson, the charge of driving under the influence of alcohol was dismissed.

Update:

On our client’s behalf, Attorney Robinson filed a Motion to Expunge all arrest and/or criminal records related to the charge of drunk driving.  On September 28, 2004, a hearing on the Motion to Expunge was held.  The Department of the Attorney General had no objection to the motion and all arrest records related to the charge of driving under the influence of alcohol were ordered expunged by the Newport County District Court.
